A Wichita Falls man charged with capital murder appeared in court this morning for a pre-trial hearing. Jesse Ryan Claiborne is charged for the shooting death of Jeremy Swearingen. Claiborne admitted to police he used a handgun in an attempt to rob Swearingen of drugs and money in December 2006. During a struggle over the gun he shot and killed Swearingen. Claiborne told police he then drumped the body in Archer County. Standard pre-trial motions were heard in the 30th District Court today. A trial date has not been set at this time, but the earliest would be November. The prosecution hasn't declared whether they're seeking the death penalty.
