Stephanie Berryman wants to move her mobile home to his lot in Burkburnett and for what she and her husband consider good reasons. 

"We really have a bad problem with birds in the spring and summer. There's a real bad problem with bird feeces and my kids can't go out and play," said Berryman.

Problem is the area needs to be rezoned. The lot previously had a mobile home on it. But late last year, the city council adopted new zoning ordinances. We found there are other mobile homes on the street where she wants to move, but she says the city council will not let her proceed.

Berryman said, "I won my vote by one, but they told me there's a percentage you have to win by, which would have meant I had to have two ahead." 

Berryman says, as she understands it, the Burk Council is tightening zoning restrictions as of last fall.

"Their explanation to me is that we're not segregating you, but this is how we want our town to look in 30 years. So were trying to get mobile homes to specific areas. They don't want stick built homes and mobiles homes together and I don't think it's fair," said Berryman 
Burk Cty Manager Mike Sly is very familiar with this case. The lot is owned by another person. Officially the owner should be the one petitioning for the change. Sly says the Planning and Zoning Commission denied the request the second time around. In order for the council to approve the zoning change, because of that denial, it had to pass council by what's called a super majority. That means a five out of seven vote. It only passed by a four of seven vote.

Sly says all is not lost. He tells me the matter can be taken up again in a year. He admits it's frustrating but that's the way it works.

I would have to ask, would this be a case of discrimination because they have a mobile home? This is saying because of that they are not able to live beside a brick home. I live in a community that I am the only mobile home on the block...assisted living on both sides of me and the hospital to the back of me and other houses around me and our neighborhood looks great!...Would this reason all be for looks?
